AgentAI — a product of Smartec USA LLC
By accessing or using AgentAI ("the Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using the Platform. These Terms constitute a legally binding agreement between you and Smartec USA LLC.
AgentAI is an AI-powered platform developed and operated by Smartec USA LLC designed to assist real estate agents and brokerages with lead management, property matching, client qualification, follow-up automation, and transaction management. The Platform uses artificial intelligence to provide insights, recommendations, and automation tools.
To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your password and for all activities that occur under your account.
AgentAI offers subscription plans as described on the Pricing page. All fees are billed in advance on a monthly or annual basis. Smartec USA LLC reserves the right to change pricing with 30 days' notice. Refunds are issued at the sole discretion of Smartec USA LLC.
You agree not to use the Platform to: (a) violate any applicable law or regulation; (b) transmit any unsolicited or unauthorized advertising; (c) impersonate any person or entity; (d) interfere with or disrupt the integrity or performance of the Platform; (e) attempt to gain unauthorized access to any part of the Platform.
The Platform uses artificial intelligence to generate recommendations, scores, and insights. These AI-generated outputs are provided for informational purposes only and do not constitute professional real estate, legal, or financial advice. Smartec USA LLC makes no warranty regarding the accuracy, completeness, or fitness for a particular purpose of any AI-generated content.
The Platform may integrate with Multiple Listing Services (MLS) and other third-party data providers. Your use of MLS data is subject to the terms and conditions of the applicable MLS. Smartec USA LLC is not responsible for the accuracy, completeness, or timeliness of third-party data.
The Platform and its original content, features, and functionality are owned by Smartec USA LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
To the maximum extent permitted by law, Smartec USA LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Platform.
Smartec USA LLC may terminate or suspend your account and access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform will immediately cease.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
